and are there any instances where AWS Had to take responsibility, and thus pay fines?
vm escape is older than the hills – we are talking 10+ years!!!
You need to read up on the shared responsibility model – if you harbour malware you are responsible, AWS monitors the entire infrastructure and you will receive warnings if any of your instances are doing things they should not
